General Framework for Foreign Investment
Principles, international agreements, and registration requirements that protect foreign capital invested in companies, real estate, and financial assets in Colombia.
Foreign investment plays a fundamental role in Colombia’s economy. A clear, efficient regulatory framework aligned with international standards is the most effective tool for attracting high-value investment with a long-term commitment to the country.
The key aspects that foreign investors should understand regarding foreign investment in Colombia are centered on the requirements governing the free inflow and repatriation of capital and investment returns, as well as the principles that ensure participation in the Colombian economy and the protection of investments made within the country.
Foreign and domestic investors enjoy the same rights and guarantees. Foreign investment receives the same treatment as domestic investment, except where otherwise provided by law.
As a general rule, foreign investment is permitted in all sectors of the economy, except for specific sectors such as national defense and security, and the processing of toxic or radioactive waste not generated in Colombia.
Foreign investment does not require prior authorization or approval from any government authority, except in specific regulated sectors such as insurance, financial services, mining, and hydrocarbons. In all cases, however, the investment must be registered with the Bank of the Republic (Banco de la República).
Foreign investors may freely remit their investment returns abroad, reinvest them in Colombia, or liquidate their investments, subject to the applicable foreign exchange regulations.
Colombia offers a stable legal framework for foreign investors. The conditions governing the repatriation of invested capital and the transfer of investment returns in effect at the time the investment is registered may not be changed to the detriment of the investor, except where the country's international reserves fall below the equivalent of three months of imports.
