Registration of the Foreign Investment

  • Any investment, including foreign currency entering the country on behalf of non-residents, which is destined to capital contributions of a company or branch of a foreign company, must be registered as foreign investment with the Colombian Central Bank.
  • In case of currency, the registration shall be done by means of the channeling of such currency through a foreign exchange market intermediary or through a so called compensation account. Furthermore, the filing of a so called Form No. 4 “Foreign Exchange Form” is required.
  • The new Decree 119 of 2017 established the rules applicable to the registration of foreing investments in the Colombian Central Bank. The registration system, based on the following aspects:
    • Eliminate the verification made by the Central Bank.
    • The information declared is granted under oath. Partial elimination of deadlines (except substitutions or cancellations: 6 months).
    • The possibility to present the registry, its corrections, updates, changes and cancellations, at any time, by the legal representative of the company that received the investment.
    • The channeling of investments will act as registration; In investments that are not channeled.
